A federal charge is more serious than a state charge, largely because of the potential penalties that might be imposed when someone is convicted. The differences between the two courts, federal and state, comes down to jurisdiction, which refers to the types of cases that a court can hear.
Immigration Holds or Immigration Detainers
An immigration hold (or detainer) is a request from the Department of Homeland Security (DHS) to local law enforcement agencies. In this request, DHS asks local law enforcement to inform DHS of the pending release of any non-citizens in the local agency’s custody so that DHS can arrange to take custody of the immigrant for prosecution based on an immigration violation.
Drug trafficking involves the transportation and distribution of illegal drugs or a controlled substance without the proper legal license or permission to do so, i.e., doctor or licensed courier transporting prescription drugs. Examples of controlled substances and illegal drugs include but are not limited to anabolic steroids marijuana, cocaine, ecstasy, amphetamines, LSD and heroin.
Removal (previously called Deportation) occurs when the United States government determines that a foreign-born individual should no longer be in the United States, and legally removes that person from the United States.
There are three general types of offenses: felonies (which can be subject to term in a state prison), misdemeanors (which can be subject to up to one year in a county jail), and infractions (which can be subject to a fine up to $100.00, plus court costs). Procedures for the different categories are somewhat different.
